Tesni, as per usual, spent her time before class in the Forest gathering herbs for a more casual use than just cooking. When it was time for class to start she parted from the forest casting a scourgify here or there for any dirt that might have stuck to her clothing while using her fingers to comb out any spiders or leaves that might've gotten caught in the curly mane she called hair. As she was tying it up she spotted the tell-tale signs of students walking out to her and straightened up as to present a strong front. If she didn't these little pubescent wankers would walk all over her. After a while when she was sure everyone that was supposed to be there was present she gave an internal sigh and decided that the time had come, the Walrus said.

"Good morning all, and congratulations on passing your OWL's. As I'm sure a minimum of you remember I'm Professor Yates and as you are all now NEWT students I don't have to moddy-coddle you." The Welsh woman gave her customary shark-like grin at her words before the flew back into her blank facade. "Today we will be learning about Merpeople, a class XXXX beast. And yes, their classification is very important. They had the chance to be called 'being' but refused because they couldn't stand being in the same category as Hags and Vampires. Merpeople are sentient beasts that live underwater, and are found all over the world. Their customs and habits are mysterious and unless you've gained the explicit trust of one they will stay this way. They, reportedly, can breathe above the waves for a time, but it is unclear if they can ever truly leave their habitat. Merpeople are creatures resembling half-human, half-fish hybrids, though they are most certainly not half-breeds. Like humans, merpeople come in a variety of appearances, though colours uncommon in humans appear to be widespread in merpeople. For instance, the majority of the Black Lake Merpeople colony have green hair, yellow eyes, and grey skin, all traits that would be very uncommon, if not impossible, for a human to naturally possess. Merpeople also seem to be taller than humans, with seven feet appearing to not be an unusual height, at least for a selkie. Merpeople are divided up into various sub-species or races, depending on where they live. The earliest merpeople lived in Greece, and were known as sirens. In modern times, those merpeople living in warmer waters take on a more beautiful appearance, while those in colder waters, such as the selkies of Scotland and the Merrows of Ireland, are less attractive.

Their exact level of intelligence as compared to humans is unknown, however, they possess many traits beyond those of mere animals. Merpeople have a developed language, Mermish, and have even created music, which they are known, as a whole, to be fond of. On land their singing sounds like a cross between a piercing shriek and a banshee wail while underwater it is one of the most beautiful sounds known. Probably why one such group is known as a siren since they can only be heard underwater while they drown the poor seamen. Anyway. evidence that the Merpeople have a thriving culture is that they live in highly organised communities, some containing elaborate dwellings made of stone, and have been known to domesticate creatures such as the Grindylow, Hippocampus, and Lobalug, the latter being used as makeshift weaponry. Other signs of their intelligence include jewelry and weapon making, production of art (both paintings and statues), and an ability to understand basic communication via gestures.

The merpeople date back to ancient Greece, where they were first known as sirens. By the modern era, however, merpeople have spread worldwide. The history of merpeople's relations with wizardkind, or at least the wizarding British government, are somewhat rocky. Chief Elfrida Clagg refused to accept merpeople as beings under her definition of the term as those who could "speak the human tongue", with Mermish not being considered adequate as it could not be understood above water. This decision upset both the merpeople and their allies the centaurs. Though they were allowed being status under Minister Grogan Stump revised 1811 definition of the term, they would eventually request to be treated as beasts once more, objecting to the fact that such Dark creatures as hags and vampires also claimed that status. Despite being considered beasts at the time, a delegation of merpeople was persuaded to attend the 1692 summit of the International Confederation of Wizards, where they would help decide what to do on the matter of hiding the existence of various magical creatures from Muggle comprehension.

As you may or may not know, there is a colony of merpeople that currently resides in the Black Lake. Next week we will meet by the lake so you may interact with the few who have volunteered. For your homework, I want two and a half feet on merpeople. Include in it what you've learned today as well additional information from your text and any text in the magical creature of the library. You may drop it off to my box in the office or personally at our next meeting. If there are no questions, class is dismissed."

Being her last class of the week, save for the Saturday night Astronomy class, Selina welcomed the hike out to the forest as a nice excuse to get out of the castle, and a good way to start her weekend. Selina was immediately intrigued about the chance to meet Merfolk, having never had the chance to do so before.

Of course, she was taking notes on the subject, knowing there'd be a paper to write on the subject. Two and a half feet on the subject meant Professor Yates wanted a pretty detailed treatise on the subject; no shocks there, this was a NEWTs level class, not a trip to a petting zoo here.

"Professor?" Selina ventured. "Do you know if there are any plans to revisit the decision on their classification? What you've told us seems ample grounds for them to be considered 'beings', given they have their own language, arts, architecture and society."

Tesni raised an eyebrow as her title was called out and listened to the question posed to her before shaking her head. "Good question but no. In order to do said discussion the Ministry would have to hold council with every sentient magical creature as well as representatives of those that aren't. Some of these creatures nearly refused being in the same room as the others the first time these classes were handed out and this was centuries ago. A few more goblin wars and some beheading later I very much doubt you could get even a handful of them even willing to consider doing it over again. That and the Ministry could very well care less about the feelings of 'lesser creatures.' Five points to Ravenclaw for a good discussion topic though. Extra credit kiddies," Tesni turned to look upon the rest of the class. "Give me an essay on which beings should have a higher or lower classification and why for extra credit towards your overall grade. No penalties if you chose not to do it. If that's all, have a good rest of the day and I'll see you next week." The short brunette watched as her students roamed back to the castle wondering just how many would actually do the extra credit. Probably just that Ravenclaw girls, that house truly never changes does it?

                                                          N E X T C L A S S

Tesni walked out early that day to the Black Lake to make sure the merpeople had gotten her last message and knew that this was the day. She didn't speak fluent mermish, she doubted anyone that didn't live underwater and have a fish tail did, but she knew enough to get that yes, they'd gotten her message, and that she looked positively delicious that day. She wasn't sure if that was a joke seeing as they don't actually eat humans but she treated it as one and merely responded to their own sharp smiles with a sharper grin of her own. She waited patiently at the edge of the lake skipping stones and playing keep away with the Giant Squid. Of course, the squid kept winning. The fun and games came to an end unfortunately as she spotted her students coming over and gave the squid an "until next time" shiny pebble.

"Afternoon kiddies. Those that haven't already please place their homework underneath that tree over there and we'll get started. Today, as you can probably guess, is our merpeople interaction. We have a few that have volunteered to interact with you students, so treat them with respect. While they are technically classified as 'beasts' they are of high intelligence and even higher propensity for violence if they think they've been wronged. Do not attempt to go into the water with them, standing at the water's edge is fine but if you go too close you may be considered intruding. You may talk to them and if you're lucky they will respond back, though not in English. If you are truly lucky and respectful, they might give you a token, nothing extravagant possibly something like a shiny bauble. If there are no questions you may begin." No sooner had the words left Tesni's mouth did heads start popping from beneath the water and come swimming as close to the students as they could without leaving the water.

                                                              ▄▀▄▀▄▀▄▀▄▀▄▀▄▀▄▀▄▀▄▀▄▀▄▀▄

Selina decided to take up Professor Yates' challenge and assemble a paper on the subject of reclassifying creatures as 'beings', but chose to take a more legalistic approach. Rather than cite which should be reclassified as 'beings', she decided to come up with a reasoned argument and a legal framework by which they might be designated as being 'people' deserving of equal treatment in the eyes of the Wizarding community at large. If nothing else, the theoretical exercise of her knowledge of Wizard Law made for an interesting thought exercise, and it was a fun research project.

As she viewed it, any creature whom displayed sentience, and use language and their own creativity, was deserving of being treated equally, which was likely not a view shared by many witches and wizards. In setting up her premise, Selina used Merfolk as her 'test case'. How could anyone whom had their own language and culture, even if others like herself couldn't comprehend the language, not be considered an equal? It defied all logic.

Needless to say, her extra credit paper ended up being longer than the two and a half she wrote on the subject of her Merfolk the Professor called for as homework, but then she'd set up what amounted to a legal brief for argument in a court if it came to it.

When Selina arrived at the lakeside to interact with the Merfolk, she had her sketchpad, a slate with which she hoped to try communicating with them, and some pretty glass beads she planned to use as a gift. Her eyes widened and she marveled at the appearance of these beings when they made their presence known.

Now your fortune came, but it's gone and it passed you by-
You plucked your feathers, now you wonder why,
You can't lift yourself and fly?
In the middle of an ocean no one's hands are dry!
If a tree falls does it make a sound?
Can the world stall from the run-around?
Can a mind think if it's in a crowd?

Aster liked Care of Magical Creatures, but Christ, Professor Yates really knew how to go on and on without even stopping to breathe. Besides that, merpeople were kind of... eh. They could probably just copy their notes and have a straight essay on them; what else was there to say? They were people who lived underwater and only seemed to have issues with wizards because wizards wouldn't leave them the ******** alone. She was more interested in actually seeing a merperson next week. Hopefully Hastings got pulled into the lake or something. She could do with a laugh.

Can a soul search if it's never found?
And can a thing grow when you cut it down?
Can we all find peace in the here and now?
You can crawl through the mud with your hands bound-
But I'll get plenty of that dirt when I'm underground.
You're a slave, and this is a slave ship;
Pull yourself out of your own grave pit.

Plopping down in the grass, Tristan curled up in a little bundled ball wrapped in his robes and waited for the rest of class to arrive. Professor Yates probably wasn't gonna let him sleep, so he forced himself upright with a huff and did his best to transfer her lecture into his notes. But Merlin, that woman can talk a storm and his hand was already cramping. She was a pretty thing to look at though, and he found himself shifting in his trousers trying to get... comfortable. Maybe he'll try and talk up one of those cute girls he saw in the hallway earlier. It is Friday, and he could do with a good snogging... But then again... He does still quite feel like the underside of a centaurs arse, so... Maybe he'll just sleep it off until after tomorrow night, instead.

»Tesni, as per usual, spent her time before class in the Forest gathering herbs for a more casual use than just cooking.

As you are all now NEWT students I don't have to moddy-coddle you." The Welsh woman gave her customary shark-like grin at her words.

Tesni told them with a nod wondering if there was any way Jason would let her into his sacred greenhouse for a smoke and a drink.«

Location : Care of Magical Creatures - Friday @ 2:00pm

Emma managed to make it the whole first week back. She had one last class to go on a Friday afternoon before she could just relax. Never mind the homework she was bound to have but she needed to break. The weekend would certainly help with that. Perhaps she could find some way to get her brain to focus. Preferable on what it was supposed to. Making her way to the clearing down by the forest, Emma recalled getting a little less than perfect on her OWL. At least she exceeded expectations for the class. That brought a small smile to her face as she met up with Professor Yates.

‘Okay, time to focus…’ Emma thought to herself as she got out her stuff. Merpeople was the subject of the day. Beginning to take notes the Hufflepuff was surprised at the class of beast. They were pretty high up on the list. Then again when she was young she always saw merpeople as the little mermaid. The Disney representation was probably far friendlier then the actual magical creature. There was so much information on merpeople and it was a lot to take in. They were smart enough to be beings but weren’t. They lived in different places and looked different depending on where they were from. They weren’t part human even though they looked semi human. That wasn’t even getting into other characteristics and the history of them.

By the time Emma heard about their love for music despite it sounding awful out of water, she was started to lose focus. Pushing away any thoughts that weren’t about merpeople, the Hufflepuff continued on with her note taking. Writing about the dwellings they had and other stuff they had made. Sadly once the history of merpeople hit, she started to completely wander. It was obvious to most that Emma was no fan of history, no matter what history it was. That was just too much for her to take in for one class.

On the bright side it was the only class Emma had that day. Writing down the homework, she wasn’t looking forward to writing a two and a half feet paper on merpeople. It was to include, what they’d just covered, and anything else she could dig up. She also added that they’d be meeting at the lake next week to meet a few merpeople. Something that would definitely be more fun then what was done today. 'Thank god...'

                                      Status: Trying to focus
                                      With: Class...

                                      Wearing: Hufflepuff Uniform

                                      Somewhere you'll fit in huh?

»Tesni was waiting for her students this time with mild interest. She thought her students might enjoy this lecture even if they wouldn't enjoy the note-taking. "Good afternoon kiddies, today we'll be learning about a very magical species of creature: the phoenix. The phoenix is a large swan-sized scarlet bird with red and gold plumage, along with a golden beak and talons, black eyes, and a tail as long as a peacock's. Its scarlet feathers glow faintly in darkness, while its golden tail feathers are hot to the touch.

Phoenixes will usually nest on mountain peaks and are gentle herbivores that are not known for fighting. As phoenixes approach their Burning Day they resemble a half-plucked turkey. Their eyes become dull, their feathers start to fall out, and it begins to make gagging noises. Then the bird suddenly bursts into flames only to rise from the ashes shortly after. In a number of days, they grow back to full size. Thanks to this ability, phoenixes live to an immense age.

The most startling of the phoenix's abilities is its ability to regenerate itself. It periodically bursts into flames when its body becomes old, and rises from the ashes as a newborn chick. This event is called Burning Day, and gives these birds a great life span, as well as the ability to take the full force of a Killing Curse and still be reborn. Phoenixes are immune to the gaze of a basilisk, which would normally kill anyone who has direct eye to eye contact, or petrify through indirect eye contact, such as seeing a glimpse of the massive serpent or its reflection.

The phoenix can also disappear and reappear at will in bursts of flames and take whoever is holding them along, similar to Apparition (though like house-elf magic, they cannot be restricted like wizards are), and boasts magical tears and song. Their tears have potent healing capabilities; for instance, phoenix tears are the only known antidote to basilisk venom. They're also able to bring a person back even from the brink of death, while the phoenix song will increase the courage of the good and strike fear into the hearts of the evil. Phoenixes are capable of lifting a great weight with their tails, such as being able to effortlessly fly up a distance with four people holding on to its tail. They can also leave messages by bursting into flame to reappear elsewhere, leaving behind a single golden tail feather.

Phoenixes are very difficult to domesticate, as Newton Scamander says in his book Fantastic Beasts and Where to Find Them, which I'm very sure you all have in class at this very moment,: 'The phoenix gains an XXXX rating not because it is aggressive, but because very few wizards have ever succeeded in domesticating it.' There are two known domesticated phoenixes, one Albus Dumbledore's pet phoenix Fawkes, and the other Sparky the team mascot for the New Zealand Quidditch team the Moutohora Macaws. Phoenixes that have been domesticated are extremely loyal to their owners, and would depart to find their own paths if their owners die, rather than finding a new master.

Well, that's enough to get your started right?"
Tesni ended with one of her trademark sharp grins. "Homework, I want at the very least two and a half feet on the phoenix. Everything from what I've said already in class and from the fruition of your own research. Not too difficult right, yes? If there are no questions, class is dismissed." Tesni told them with a short shooing wave.«

Tesni told them with a nod wondering if there was any way Jason would let her into his sacred greenhouse for a smoke and a drink.«

You've been acting awful tough lately
Smoking a lot of cigarettes lately
But inside, you're just a little baby, oh.
It's okay to say you've got a weak spot
You don't always have to be on top
Better to be hated than loved, loved, loved for what you're not

»Tesni walked out early that day to the Black Lake to make sure the merpeople had gotten her last message and knew that this was the day.

If there are no questions you may begin." No sooner had the words left Tesni's mouth did heads start popping from beneath the water and come swimming as close to the students as they could without leaving the water.«
